Abstract
This study aims to engage with the controversy arising from the relationship between the concrete guarantee of political and fundamental rights in a non-exclusive manner and the enhanced quality of democracy. In terms of academic debate, the article discusses the conception of democracy in complex and diverse societies, emphasizing the principle of equality and the adoption of instruments to improve and deepen democratic institutions, making them more responsive. This is approached based on the experience of the jurisprudence of the Federal Supreme Court and the normative actions of the Superior Electoral Court.
