Abstract
The objective of this article is to analyze the institute of ineligibility of the justices of the peace in the Portuguese legal system, as well as in the Brazilian. It brought to light the understanding rendered in Judgment nº 250/2009, of Case nº 389/2009, of the Rapporteur of Counselor Benjamim Rodrigues, of the Constitutional Court of Portugal, which determined the ineligibility of the justices of the peace in Portugal. In Brazil, the judgment of the Direct Action of Unconstitutionality nº 2938-0/MG, whose Rapporteur was in charge of the Minister Eros Graus, demonstrated the passive electoral capacity of the justice of the peace. For this, the type of bibliographic research, as a deductive method, was used as a methodology, through the textual, thematic and interpretative analysis of legal works on the subject, as well as the type of documentary research, through the analysis of the content of the Federal Constitution the norms inherent to the topic.

A Escola Judiciária Eleitoral do Tribunal Superior Eleitoral convida, em chamada permanente, a comunidade científica e os demais profissionais interessados na publicação de seus trabalhos a submeterem seus textos para publicação na revista Estudos Eleitorais (ISSN 1414-5146). 2. Serão admitidos trabalhos que versem sobre Direito Eleitoral, eleições e democracia que estejam em conformidade com a linha editorial da revista, respeitando, de todo modo, o debate democrático dos temas, em nível científico. 3. Os trabalhos deverão atender às normas de submissão, como requisito fundamental para aceitação dos artigos pela coordenação da revista. 4. A seleção de trabalhos para publicação é de competência do editor da revista e será feita mediante a análise dos pareceres técnicos. Os trabalhos recebidos para análise e aprovados não serão devolvidos aos autores. 5. Será facultado ao autor apresentar novamente texto anteriormente submetido e não aceito para publicação, desde que realizadas as adaptações sugeridas no parecer anônimo enviado pela EJE/TSE. Não serão admitidos recursos.
