Abstract
This paper aims at investigating the potential existence of independent candidacies in the brazilian electoral system under the precepts of the American Convention on Human Rights and the interpretation of the Supreme Federal Court (STF) on the normative status of international human rights treaties in Brazil. To achieve this, the Convention’s provisions on political rights were analyzed in order to verify if there is normative incompatibility between the Act and the Brazilian Federal Constitution. The research focused than on the normative status of the Convention within national legislation according to STF recent decisions. It was found that the STF adopted the theoretical approach of supralegality for international treaties on human rights, according to which these legal acts are hierarchically allocated between the Constitution and other sources of law. The provisional conclusion was that the Convention does not allow signatory states to restrict the right to stand as a candidate with conditions not listed in article 23, such as party affiliation. In addition, the solution to this legal contradiction seems to rely on the legal effects of supra-legal status, which, according to STF, has the power to suspend the effectiveness of any infra-constitutional source of law that differs from the Pact of San Jose. Hence, mandatory party affiliation should produce no legal effects.

Serão admitidos trabalhos que versem sobre Direito Eleitoral, eleições e democracia que estejam em conformidade com a linha editorial da revista, respeitando, de todo modo, o debate democrático dos temas, em nível científico. 3. Os trabalhos deverão atender às normas de submissão, como requisito fundamental para aceitação dos artigos pela coordenação da revista. 4. A seleção de trabalhos para publicação é de competência do editor da revista e será feita mediante a análise dos pareceres técnicos. Os trabalhos recebidos para análise e aprovados não serão devolvidos aos autores. 5. Será facultado ao autor apresentar novamente texto anteriormente submetido e não aceito para publicação, desde que realizadas as adaptações sugeridas no parecer anônimo enviado pela EJE/TSE. Não serão admitidos recursos.
